iBuyTix – Terms of Service

iBuyTix is a service of iTIX NOW, LLC ("iBuyTix," "we," "our," "us"). We buy event tickets directly from fans for cash. By creating an account, requesting an offer or selling tickets to us (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy.

1. Eligibility

  • You must be at least 18 years old and able to enter into a binding contract.
  • You must give accurate account information, including a phone number you can verify by text and an email address you can verify by code.
  • We may refuse, suspend or close any account at any time, including for suspected fraud or a breach of these Terms.

2. How it works

  1. Request. You tell us the game, where your tickets are held (for example Ticketmaster or SeatGeek), and the section, row, seats and quantity.
  2. Offer. We may send you a cash offer by text and email. Making a request does not oblige us to make an offer, and we may decline any request.
  3. Offer expiry. Each offer is good for 60 minutes from when we send it, unless the offer says otherwise. After that it expires, and any new offer may be different.
  4. Acceptance. When you accept, you agree to sell us the exact tickets described in the offer for the offered amount, and you choose how to be paid (Venmo or PayPal).
  5. Transfer. You must transfer all the tickets in the offer to tickets@ibuytix.com through the official platform where they are held, within 2 hours of accepting and in any case before the event starts. If you don't, we may cancel the sale.
  6. Payment. We pay you only after the tickets have arrived in our account and we have confirmed they match the offer. We pay the full offered amount to the Venmo or PayPal account you gave us. We charge you no fees. Your payment provider may have its own terms or fees.

3. Your promises about the tickets

By requesting an offer and accepting it, you promise that:

  • You own the tickets, or are authorized by their owner to sell them, and you have the right to transfer them.
  • The tickets are genuine and valid, and the details you gave us (event, section, row, seats, quantity, restrictions) are accurate.
  • The tickets have not been sold, transferred, promised or listed to anyone else, and will not be.
  • The tickets will not be canceled, reclaimed, reported lost or stolen, reissued or otherwise invalidated by you or anyone acting for you.
  • Selling the tickets does not break any agreement you have (such as a season ticket or account agreement) or any law.

4. If something goes wrong

  • Wrong or missing tickets. If the tickets you send don't match the offer, aren't all sent, or arrive late, we may cancel the sale, return any tickets you sent, or make you a new offer for what actually arrived.
  • Invalid tickets after payment. If tickets we paid for turn out to be invalid, canceled, reclaimed, duplicated or otherwise unusable for a reason within your control or that breaks your promises above, you must repay the full amount we paid you within 7 days of our request. We may also pursue any other remedy the law allows.
  • Event changes. If an event is canceled or postponed before you transfer the tickets, the offer is void. After we have paid, any refund or credit from the event organizer for those tickets belongs to us.
  • Account action. We may block your account for fraud, repeated failed transfers or a breach of these Terms, and we may share relevant information with the ticket platform, payment provider or law enforcement where appropriate.

5. Text messages

By creating an account and giving us your mobile number, you agree to receive transactional text messages from iBuyTix about your account, requests, offers, transfers and payments, sent from the same number used by iTIX NOW. Message frequency varies. Message and data rates may apply. Reply STOP to stop all texts from that number (this also stops iTIX NOW texts), or HELP for help. We do not send you marketing texts unless you separately agree.

6. Prohibited conduct

  • Submitting tickets you don't own or can't transfer, or false information.
  • Selling the same tickets to anyone else after accepting our offer.
  • Using someone else's account, payment details or identity.
  • Interfering with the Service, scraping it, or using it for any unlawful purpose.

7. Independence

iBuyTix and iTIX NOW are not affiliated with, sponsored by or endorsed by any team, league, venue, Ticketmaster, SeatGeek or other ticketing platform. Team and event names are used only to describe the tickets.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available." To the fullest extent permitted by law, our total liability to you for any claim relating to the Service or a sale is limited to the amount we offered for the tickets in that sale, and we are not liable for indirect, incidental, special or consequential damages. Some places do not allow these limits, so they may not apply to you in full.

9. Indemnity

You agree to cover any loss, claim or expense (including reasonable legal fees) we incur because of tickets you sold us that were not as promised, or because you broke these Terms or the law.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at support@ibuytix.com and try to resolve it informally for at least 30 days. Any claim that is not resolved must be brought in the state or federal courts located in Broward County, Florida, and you and we consent to their jurisdiction. Either party may bring a qualifying claim in small claims court.

11. Changes

We may update these Terms from time to time. The updated version is posted here with a new "last updated" date and applies to requests made after that date. An offer you accepted stays governed by the Terms in effect when you accepted it.
